These terms are the agreement between Dafatir and the business that subscribes to a Dafatir product. They cover Dafatir POS, Dafatir Books, and Hiwar, together with this website and any other Dafatir product you subscribe to. Questions go to admin@dafatir.app.
Who this agreement is between
This agreement is between Dafatir and the business named on the subscription — the merchant. By subscribing, or by using a product, the merchant accepts these terms, and the person accepting them confirms they are authorised to do so for the business. Where a separately signed agreement with us says something different, that agreement wins over this page.
Your account and your staff
A subscription belongs to the business, not to the person who set it up. What is done under the account is the merchant's responsibility.
- Keep sign-in credentials and till PINs confidential. Write to admin@dafatir.app as soon as you believe one has been compromised, and we will help you rotate it.
- You add your own staff and assign each of them a role. What they do under those roles is your responsibility, and the role you give them is what limits what they can reach.
- Keep your business details accurate — the trading name, the tax registration, and the address we bill and write to. An invoice, a price-change notice and a deletion confirmation all go to the address on the account.
Dafatir is software for businesses. It is not offered to consumers, and not to anyone under 16.
What you are subscribing to
Each Dafatir product is sold on its own subscription. The products share one database, one ledger and one inventory underneath, and what a subscription decides is which of them you can open.
- You subscribe per product, and per the units that product is priced in — a till for the point of sale, a connected number or a seat for Hiwar. What you are entitled to is what your subscription says.
- Data is written for every product whether or not you subscribe to it, because they share one database. A product you have not subscribed to is closed to you rather than empty: subscribe later and the history is already there.
- You can add a product, add units, or move between plans at any time. An increase takes effect immediately and is charged pro rata; a reduction takes effect at the end of the period you have already paid for.
- Where we offer a trial or a pilot, we say in writing what it includes and when it ends. A trial becomes a paid subscription only if you ask it to.
Fees, VAT and how you pay
Prices are quoted per product and per billing period, and are shown to you before you commit to them.
- We bill in Israeli new shekels, Jordanian dinars, or US dollars. The currency is fixed on your account and shown on every invoice; we do not convert between them silently.
- Value added tax is charged where it applies — 16% in the West Bank — and is shown as a separate line, never folded into the headline price.
- We collect by the rails our merchants actually use: cash to your Dafatir representative, bank transfer, a Jawwal Pay merchant QR, a PalPay merchant QR, or e-Sadad. Every payment is reconciled against your account and receipted.
- Meta's conversation and call charges are passed through at cost, on their own line, with the figures Meta reported to us for that period. We do not mark them up.
- We invoice in advance for the subscription period, and in arrears for anything metered, such as Meta's charges. Invoices are issued to the business named on the account.
- If an invoice goes unpaid we write to you before anything changes. We may suspend access to a product while it stays unpaid. We do not delete data for non-payment, and we do not charge interest.
Fees can change. We give at least 30 days' notice in writing before a price change takes effect, and it never applies to a period you have already paid for.
Using WhatsApp through Hiwar
Hiwar connects your own WhatsApp Business Account to Dafatir through Meta's WhatsApp Business Platform. That connection is yours, and so are the obligations that come with it.
- The WhatsApp Business Account and the number on it are yours. You authorise the connection yourself in Meta's sign-up flow, and you can end it at any time from Hiwar or from Meta.
- Meta's own terms govern what Meta does with the same messages. Nothing here changes your agreement with Meta, and nothing in it removes an obligation Meta places on you.
- You are responsible for having a lawful basis to message the people you message, and for honouring an opt-out. Our Acceptable Use Policy sets out what that means in practice.
- Meta can restrict or disable a number for its own reasons — a quality rating, a policy breach, a volume of blocks. We tell you what Meta told us and we help you appeal, but we cannot overturn it.
If Meta withdraws or changes the platform Hiwar is built on, we will tell you what it means for your number as soon as we know, and we will not charge you for a capability you can no longer use.
Your data is yours
What you put into Dafatir, and what your customers generate through it, belongs to you.
- You keep every right in your business records, your customer records, and your conversations. We hold them to run the service for you and for nothing else — the Privacy Policy sets out the limits, and they are limits we bind ourselves to.
- For your own customers' information you are the controller and we are your processor: we act on your instructions. If one of your customers asks us directly, we forward the request to you and act on your answer.
- You can export your data at any time while the subscription is active, in a portable, machine-readable form, without asking our permission.
- After an account closes we keep your data available for 30 days so you can export it, then delete it — apart from the accounting and VAT records the law requires us to keep, which are separated and deleted when their statutory period ends.
How the service may be used
There are things you may not do with Dafatir, and the messaging rules in particular are strict — because a message sent through Hiwar arrives on somebody's personal phone. They are set out in full in the Acceptable Use Policy, which forms part of this agreement.
Availability and support
We work to keep the service running, and we are honest about what that promise is worth.
- The point of sale is built to work with no network at all. A till keeps selling through an outage — ours or yours — and syncs when the connection returns. That is a design guarantee, not a best effort.
- We deploy changes continuously and aim for no interruption. Where planned work will interrupt something, we tell you in advance.
- Support is by WhatsApp, phone and email during business hours, and your Dafatir representative is a real person you can reach.
- The cloud service carries no contractual uptime figure. Where we publish a service-level target we hold ourselves to it in writing; until we do, we would rather you did not rely on a number nobody has committed to.
We operate in a region where power and connectivity are not guaranteed. The offline-first design is our answer to that, and it is the part of the promise we will not compromise.
Changes to the service and to these terms
We improve the products continuously, and most changes are additions. Where we intend to remove or materially change something you rely on, we give at least 30 days' notice in writing. Where we change these terms, we post the new version with a new date at the top and tell merchants directly before a material change takes effect. If you do not accept a material change, you may end your subscription and we will refund the unused part of the period.
Ending the agreement
Either side can end it. What differs is the notice, and what happens next.
- You can end a subscription at any time, effective at the end of the period you have paid for. We do not require a reason and we do not charge an exit fee.
- We can end it on 30 days' written notice, or immediately if you breach these terms or the Acceptable Use Policy in a way you do not fix after we ask.
- We can suspend access while an invoice is overdue, while we investigate a suspected breach, or where a law or Meta requires it. We tell you why, and we restore access as soon as the reason ends.
- Whatever the reason, you have 30 days after the account closes to export your data before it is deleted. The routes are set out on the Data Deletion page.
Warranties and liability
We stand behind the product, and we are direct about the limits of that.
- We provide the service with reasonable skill and care. Beyond that we make no warranty that it will be uninterrupted, error-free, or fit for a purpose we have not agreed in writing.
- Our total liability to you in any twelve-month period is limited to the fees you paid us in that period. That is the ordinary limit for software at this price, and we would rather state it plainly than bury it.
- We are not liable for indirect or consequential loss, for lost profit, or for loss caused by a third party we do not control — Meta restricting your number, a bank declining a transfer, an outage at a hosting provider.
- Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
You keep your own books. Dafatir raises ledger entries from what you record, and they are accurate to what you record — but your tax filings are yours, and we are not your accountant.
Governing law and disputes
This agreement is governed by the law of Palestine, and the competent courts of the West Bank have jurisdiction over it. If something goes wrong, write to us first: nearly everything is settled by a phone call with your representative, and we would rather fix a problem than argue about one.
